27 year old Jiffy Javenella, the Filipino husband of an American woman, 58 year old Donita Ganzon, has reportedly been taken off the road to citizenship, apparently because of his wife's identity. He may also be deported, if he can't
convince a federal judge to step in. Fortuntaley he's filed a lawsuit.
Its seems Ganzon, also from the Philippines, became a citizen in 1987, following her gender reassignment surgery.
This really get trickier, as here's where so-called "national security" comes into play: According to the Department of Homeland Security (in my opinon, a pretty much useless agency
that spews out inaccurate and even false information) and U.S. policy turns thumbs down on change of gender in order for a marriage between two persons - born of the same sex - to be
considered legal.
Citing the 1996 Defense of Marriage Act, the government has justified their denial of citizenship and residency to Javenella, based on his "illegal same-sex marriage."
I fear Transgenderd folks overall, whether born in America or not, will be facing tougher challenges when it comes to this "catch all" farce tagged as "national security."
Many American TG's have already come under intense, and often embarassing, scrutiny just by merely travelling by airline within our own country.
